Wood burning stove rules for homes in England
Wood burners are not banned in England, but installing one is controlled building work. The appliance, hearth, air supply, chimney or flue, carbon monoxide alarm and notification route must be considered together for the individual property.

Approved Document J is the main statutory guidance
Part J addresses combustion appliances and fuel-storage systems. Its guidance covers air supply, discharge of combustion products and protection of the building, including hearths, fireplaces, flues and chimneys.
It is read alongside the tested instructions for the exact stove and chimney system. Product-specific requirements can include the flue arrangement, hearth provision, permitted fuel, ventilation and distances from combustible material.
The installation must be notified
Since 2005, fixed solid-fuel installation work in England and Wales has required notification to the relevant local authority. A registered installer may self-certify qualifying work within the approved competent-person scope. Otherwise, the correct building-control route is needed.
Keep the Certificate of Compliance or building-control completion evidence, commissioning record, appliance instructions and chimney-system information with the house documents.
Smoke control is an address and appliance check
Inside a smoke control area, wood can only be burned in an appliance exempted for that purpose and used under the attached conditions. Authorised smokeless fuel is a separate route where the appliance permits it.
The government map is indicative. Ask the relevant local authority to confirm the property, then verify the exact stove on the current official exemption information. Ecodesign compliance does not automatically establish smoke-control exemption.
Hearth, clearance and air requirements are site-specific
The hearth must be appropriate for the appliance and construction. Nearby combustible material may include concealed timber as well as visible beams, furniture and finishes. There is no responsible universal clearance that applies to every stove.
Ventilation is also assessed for the appliance and property. Extractor fans, airtight construction and other combustion appliances can affect the design, while a direct-air option must be expressly compatible with the selected model.
The chimney is a complete system
An existing chimney is assessed before reuse. A flexible liner is not imposed automatically on every chimney, but the finished route must safely convey combustion products and match the stove. New insulated systems need compatible components, support, penetrations, clearances and access for inspection and sweeping.
Planning permission, listed-building consent, conservation controls or leasehold consent may apply separately from Building Regulations. Resolve them before committing to an external route or installation.
Carbon monoxide protection accompanies the installation
Approved Document J provides for a carbon monoxide alarm in the same room as a new or replacement fixed combustion appliance. For a solid-fuel installation, its guidance places the alarm 1m to 3m horizontally from the appliance.
On a ceiling, the alarm should be at least 300mm from a wall. On a wall, it should be high up but at least 150mm below the ceiling. Follow the alarm instructions and applicable standard as well. An alarm warns of danger; it does not replace correct installation, commissioning or maintenance.
Common questions
Are domestic wood burners banned in England?
No. Installation and use remain possible, subject to Building Regulations, appliance and fuel requirements, smoke-control rules and any property-specific permissions.
Is HETAS registration itself the legal requirement?
HETAS is a competent-person notification route. Work not self-certified through that route still needs the appropriate Building Regulations approval and local-authority notification.
Does every chimney have to receive a flexible liner?
No blanket rule requires one in every chimney. The existing chimney and proposed appliance must be assessed, with a suitable system specified where needed.
Can any Ecodesign stove burn wood in a smoke control area?
No. The exact appliance must be exempted for that fuel and used under its conditions. Confirm the address with the council and the model through official information.
Where is the carbon monoxide alarm positioned?
Document J guidance puts it in the same room and 1m to 3m horizontally from the appliance, with additional ceiling or high-wall placement limits and the alarm instructions followed.
